Asheville vice mayor faces allegations of dual residence. Official (who is an attorney) received primary-residence tax breaks on Atlanta home; claims she was ‘unaware’ until recently.

ASHEVILLE , N.C.  — Asheville Vice Mayor Antanette Mosley is under investigation by the North Carolina State Board of Elections regarding her residency and voting eligibility by claiming two primary residences at the same time.

The allegations over Mosley allegedly claiming two primary residences are leading to questions about her integrity and, possibly, her ability to hold onto her job,” Asheville television station WLOS (News 13) reported on Dec. 12.

Meanwhile, Gene Ellison, Mosley’s attorney, told News 13, “It’s all about the destruction of individuals, rather than the quality of the person that’s serving.” 

News 13 added, “This alleged violation is raising concerns over whether Mosley knowingly claimed two primary residences to run for office while also claiming tax benefits in Georgia.”

Ellison also told the TV station, “If she’s made a mistake, an oversight on some exemptions for moving to Asheville and moving from Georgia, she will accept the responsibility and pay the tax owed on that.”

News 13 added, “At the time of the election, her voter’s registration showed her primary address as 3 Devonshire Place in Asheville.

“Records with Atlanta’s Fulton County Tax Assessor, however, show she was claiming a homestead exemption on a property in Northwest Atlanta at the same time, something that, according to the tax assessor, only you can do if the home is your primary residence.

“Over the years, Mosley’s tax exemption on the Northwest Atlanta property has grown to as much as $118,000 in a single year, saving her as much as $3,150 in taxes in a single year.”

As for Mosley’s legal situation, Asheville City Attorney Brad Branham stated the following in a statement on behalf of the city:

“Concerns regarding the residency status of the vice mayor do not require any present action by the city. The local board of elections bears the responsibility for dealing with official challenges to eligibility.”

News 13 noted, “The Buncombe County Board of Elections states that, to run for office, a potential candidate needs to be registered to vote in his or her local primary residence in his or her district.

 “Any discrepancy or allegation of fraud can be addressed through a process called a ‘challenge.’ Once a challenge is filed, a hearing before the board can result in a determination to refer the matter to the State Board of Elections. So far, no challenge has been filed disputing the accuracy or intention of Mosley’s actions.

“Should the vice mayor choose to run for re-election to the council in 2026, she is required to file by noon Dec. 19,” News 13 stated.

In response, Ellison told News 13 prior to the filing deadline that“this is strictly politics trying to intimidate her to keep her from filing next week.” 

Meanwhile, News 13’s “Comment Bubble” that followed its story included the following assertions:
